Terms of Service

1. Acceptance of Terms

By accessing or using Hot Thai Girls (the 'Platform'), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not access or use the Platform. Your continued use following any modifications constitutes acceptance of the revised Terms.

2. Platform Description

Hot Thai Girls is a classified advertising intermediary that provides a platform for users to post and view advertisements for companionship and social escort services. The Platform is not an escort agency, a brothel, or a procurement service. We do not employ, represent, screen, endorse, or act as agent for any advertiser. We do not arrange, facilitate, broker, or participate in any meetings, transactions, or agreements between users. All interactions between users occur solely at their own discretion and risk, entirely outside the scope of the Platform's involvement.

3. Eligibility

You must be at least 18 years of age to access or use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. By posting a listing, you further warrant that any person described or depicted in the listing is at least 18 years old and has given informed consent to the listing. The Platform reserves the right to request proof of age at any time and to immediately suspend or terminate access for any user who cannot provide satisfactory verification.

4. User Accounts

To access certain features you must register for an account. You are responsible for maintaining the confidentiality of your credentials, providing accurate and current information, and all activity under your account. You must notify us immediately at admin@hothaigirls.com of any unauthorised use. The Platform is not liable for losses arising from failure to secure your credentials.

5. Prohibited Content

Users may not post, upload, or transmit any content that:

• Offers, solicits, advertises, or procures sexual services in exchange for money or anything of value, constituting procurement under Section 8 or advertising under Section 16 of the Prevention and Suppression of Prostitution Act B.E. 2539 (1996);
• Constitutes advertising in the manner of trafficking in persons under Section 11 of the Anti-Trafficking in Persons Act B.E. 2551 (2008), including any content suggesting coercion, debt bondage, restricted movement, or exploitation;
• Is pornographic, obscene, or sexually explicit, prohibited under Section 14(4) of the Computer Crime Act B.E. 2550 (2007) and Section 287 of the Criminal Code;
• Depicts, involves, or references any person under 18 years of age in a sexual or escort context, prohibited under the Child Protection Act B.E. 2546 (2003) and Sections 11-12 of the Prostitution Act;
• Contains false, misleading, deceptive, or fraudulent information about any person or service;
• Infringes the intellectual property, privacy, or other rights of any third party;
• Violates any applicable law or regulation of the Kingdom of Thailand or any other applicable jurisdiction.

Violation may result in immediate content removal, account termination, and referral to law enforcement authorities.

6. User Content

You retain ownership of content you submit ('User Content'). By posting, you grant Hot Thai Girls a non-exclusive, worldwide, royalty-free, sublicensable licence to use, display, distribute, reproduce, and modify your User Content for the purpose of operating the Platform. You represent that: (a) you own or have the necessary rights to your content; (b) posting does not violate any third-party rights; (c) your content is accurate and does not contain prohibited content as described in Section 5.

7. Content Moderation and Takedown

We reserve the right to review, screen, modify, or remove any User Content at our sole discretion without prior notice. In accordance with the Computer Crime Act B.E. 2550 (as amended B.E. 2560) Section 15 and the Ministerial Notification on Service Provider Liability, we will remove content upon lawful government or court notice within the following timeframes: pornographic content within 3 days; false or distorted information within 7 days; national security threats within 24 hours. Users may report content at admin@hothaigirls.com with the listing URL and reason. We aim to review reports within 48 hours.

8. Disclaimer of Warranties

All listings are user-generated content. Hot Thai Girls does not screen, verify, endorse, or take responsibility for any advertiser, listing, or its accuracy. The Platform is provided 'as is' and 'as available' without warranties of any kind, express or implied. Any compensation exchanged between users is solely for time and companionship. The Platform has no involvement in and accepts no responsibility for any private arrangements between users.

9. Legal Compliance

You warrant that your use of the Platform and all content you post complies with all applicable laws of the Kingdom of Thailand, including but not limited to: the Prevention and Suppression of Prostitution Act B.E. 2539 (1996); the Anti-Trafficking in Persons Act B.E. 2551 (2008); the Computer Crime Act B.E. 2550 (2007) as amended B.E. 2560 (2017); the Personal Data Protection Act B.E. 2562 (2019); the Criminal Code Sections 282-287; the Child Protection Act B.E. 2546 (2003); and the Electronic Transactions Act B.E. 2544 (2001). You are solely responsible for ensuring your use is lawful in your jurisdiction.

10. Limitation of Liability

To the maximum extent permitted by Thai law, Hot Thai Girls and its owners, officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Platform. Our total aggregate liability shall not exceed the greater of THB 1,000 or the total amount paid by you to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Hot Thai Girls and its affiliates from all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) your violation of any applicable law.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute shall be subject to the exclusive jurisdiction of the competent courts in Bangkok, Thailand. Where these Terms are provided in both English and Thai, the Thai-language version shall prevail in case of any discrepancy.

13. Changes to Terms

We may modify these Terms at any time. In accordance with the Royal Decree on Digital Platform Service Businesses B.E. 2565 (2022), material changes will be notified at least 15 days before taking effect. We will post the revised Terms on this page and update the 'Last updated' date. Your continued use after the effective date constitutes acceptance.
